地方创新性立法的限度及其规范化

地方创新性立法是推进地方治理法治化的重要手段,鼓励地方立法创新是完善我国立法体制的应有之义。为实现地方创新性立法的规范化,应明确地方性事务的判断标准,引入重大事项请示报告制度,加强立法决策量化论证。     

The optimisation of fingermark enhancement by VMD and Lumicyano™ on thermal paper

The enhancement of fingermarks on thermal paper can be challenging due to background staining caused by polar solvents used in fingermark enhancement techniques such as ninhydrin. This study explored a commercial one-step superglue fuming process, Lumicyano™, and Vacuum Metal Deposition (VMD) to develop fingermarks on this substrate and overcome this issue. Different sequential treatments involving Lumicyano™ and a combination of VMD methods were investigated with varying degrees of success with some sequences being highly sensitive. The VMD processes, however, were observed to generally be more effective at enhancing marks, whereas Lumicyano™ provided little or no benefit on this paper type. The results indicate that Lumicyano™ is only beneficial as a pre-treatment when the entire sequence of gold/zinc and silver/zinc is taken to completion. The gold/zinc and silver/zinc VMD processes were optimised on five different thermal papers, and the optimised techniques were then directly compared to determine which was more successful on each thermal paper type as a single treatment.     

我国监察官制度的立法构建——对监察官范围和任职条件的建议

通过立法构建监察官制度是贯彻实施监察法的要求，也是监察官专业化的客观需要。通过监察官法确认监察官专业化的发展目标和基本框架，有利于推进监察官制度的法治化，促进监察官队伍高质量发展。针对中纪委监察官法（草案初稿）关于监察官范围和任职条件的规定，提出以下立法建议：“全员式”进入监察官序列的设计思路值得商榷。监察官属于特殊的监察人员，其范围应小于监察人员。监察人员也不同于监察机关工作人员。适当放宽监察官任职的身份限制。取得法律职业资格虽然不宜作为初任监察官的任职条件之一，但是可在初任监察官考试时享有法律科目的免试或作为未来晋升时的考量因素。     

窃听、窃照专用器材立法完善思考

非法使用窃听、窃照专用器材屡禁不止，对公众隐私、国家安全和公共秩序造成了严重侵害。究其原因，现有的法律制裁体系存在漏洞，惩戒力度不足，相关法律之间存在冲突。面对当前愈演愈烈的犯罪形势，有必要重新检视立法的相关规定，完善法律制裁体系。破解这一难题，首先，应当完善刑事制裁，修订《刑法》第283条和284条的相关规定，提升法定刑的幅度，增加罚金刑；其次，应将非法生产、使用和销售间谍专用器材以及非法生产、使用和销售窃听、窃照专用器材的行为纳入《治安管理处罚法》的调整范畴，同时，还应当探索对可能用于窃听、窃照的专用器材设定行政许可的可行性。     

立法视角下的《反邪教法》立法必要性探讨

邪教犯罪是当前世界各国共同面临的重要社会问题，也是我国当前和今后一个时期预防与打击各种社会犯罪中的首要任务之一。本文梳理我国打击邪教犯罪方面的立法规定，针对我国邪教问题表现出来的复杂性和多样性，指出迅速制定出台《反邪教法》，从而对其进行有效的规范和控制。     

Raising citizens in ‘mixed’ family setting: mothering techniques of Filipino and Thai migrants in Belgium

As states increasingly regulate ‘mixed’ family formation, self-positioning has become central to the lives of migrant spouses, including women. To understand this process, the present article investigates the mothering techniques of Filipino and Thai migrant women in Belgium, that is, the decisions, actions and ways of being they consciously enact in response to state policies ‘here’ and/or 'there' to secure the mother–child bond in space and time. Interviews and observations reveal these women’s main techniques: obtaining Belgian nationality for themselves, prioritising a single nationality (Belgian) for their children and staying at home (in the case of Filipino migrant women) or working (in the case of Thai women). This self-positioning sets these women’s own path and prepare their children’s route towards full, active membership in the nation. Mothering appears therefore as a fertile site of citizenship, which from afar echoes the public–private divide but in close-up reveals the porosity of such dichotomy.     

浅谈我国被迫辞职制度的不足与完善 —— 以司法实务为视角

我国劳动法关于被迫辞职的立法经历了一个不断完善的过程。现有的被迫辞职制度存在适用范围狭窄、认定条件宽松、相关规定不明确以及用人单位的法律责任过轻等问题,进而导致司法实务中部分裁判的社会效果不佳。可以从采取例举与一般规定相结合的立法技术、主客观相结合的判断标准、规定合理的催告期、按违法解除承担法律责任等方面予以完善。     

Quality Management in Public-Sector Organizations: Evidence from Six EU Countries

Although there is considerable evidence for the hypothesis that an efficient use of management techniques is the key to a good public service delivery, a lot of studies come to the conclusion that there is only partial, reluctant implementation or even a general lack of the use of such techniques by public managers. This paper examines the determinants for the use of quality management techniques in public sector organizations from six EU countries. It turns out that especially more organizational autonomy and result control appear to be of importance while, surprisingly, the combination of these variables leads to negative results.     

法律法规名称英译研究

法律法规的名称往往揭示了法律法规所要调整或规范的对象、主要范围或主要内容,故而至关重要,但目前鲜有学者对我国法律法规名称的英译进行探讨。在权威机构颁布的法律法规英译本中,法律法规名称的翻译在术语、语法及句法等方面都存在诸多值得商榷之处。中西方思维、文化及心理上的巨大差异导致了中英文表述上的不同。从翻译目的论的视角观之,法律法规名称的英译需正确选用术语、注重译入语的语法和句法表述习惯,尤其是参照外国法律法规名称的表达方式,方能最终实现我国法律法规英译的目的。     

立法过程中专家咨询制度的多维面相

我国正处于全面建设小康社会的关键时期,利益多元化与利益失衡现象并存。如何有效地回应社会需求,避免立法疏误,提高立法品质,增强立法的正当性是立法主体必须面对的问题。专家咨询制度具有多维面相,从政治民主的角度看是立法民主的表现,从科学决策的角度看是立法科学的保证,从法治的角度看是立法合法的要求,从公共治理的角度看是立法正当的期待。全面认识和把握专家咨询制度的多维面相,有助于充分发挥其在立法过程中的功能和作用。
